Crime & regulatory law

Considerable practice specialising in prosecuting and defending all aspects of Crime and Regulatory Law with a particular emphasis on Fraud and Trading Standards Law. Frequently involved in advising individuals and companies on “Due Diligence” systems. Experience advising local authorities on case management, preparation and prosecution. Regular areas of work include, but are not limited to:

Trade Marks Act 1994

Expert knowledge of the Trade Marks Act 1994 and conducts many cases at all levels under the same. Involved in cases concerning the sale and/or possession of counterfeit DVD/MP3s and clothing on a regular basis. Experienced at handling cases involving large scale distribution of counterfeit merchandise via auction websites and other channels. Prosecuted Wales’ largest case concerning conspiracy to sell counterfeit merchandise (Cardiff County Council v Khan and Others 2006). In addition experience in other legislative provisions often associated with counterfeiting cases, such as the Video Recordings Act and The Copyright, Designs and Patents Act 1988. Expert knowledge of the Proceeds of Crime Act (see below) to ensure continuity throughout the enforcement process when dealing with such cases.

Consumer protection from Unfair Trading Regulations 2008

Experienced in a variety of cases under this legislation, from false odometer readings to holiday brochures. Regularly involved in cases concerning the prosecution and defence of company directors. Provides training and lectures on the same to local authorities.

Food & food safety

Considerable experience dealing with all aspects of Food Safety legislation. Recent significant cases involve prosecuting large supermarkets on behalf of numerous local authorities for food safety, food labelling, pricing and other consumer protection offences.

Environmental & Health and Safety legislation

Prosecutes and defends breaches of Environmental and Health and Safety including under the Environmental Protection Act 1990, Health and Safety at Work Act and the Food Safety Act 1990.

Other regulatory offences

Considerable knowledge of a vast amount of legislation introduced to protect consumers from unfair trade practices, including The Consumer Protection Act 1987, The Consumer Credit Act 1974, The Fair Trading Act 1973, The Business Names Act 1985, the General Product Safety Regulations 2005 and the Enterprise Act 2002.

Regularly conducts cases concerning the sale of age restricted products, including offences under the Licensing Act 2003.

Fraud & significant crime

Experience acting in Large Drug and Fraud cases. Involved in Very High Costs Criminal Cases on a regular basis. Recent cases include Operation Reptile, Kalouchin and Pegasus.


Considerable experience conducting cases under the Licensing Act 2003 and the Local Government (Miscellaneous Provisions) Act 1982 in respect of alcohol, Private Hire and Hackney Carriage licensing. In addition regularly appears in cases involving applications for such licenses or extension to or revocation of existing licenses. Advises and represents individuals and companies in all aspects of liquor licensing, PELs, nightclubs, etc., and underage sales.

Proceeds of crime

Specialist in matters under the Proceeds of Crime Act 2002 and regularly lectures to local authorities and solicitors concerning the same. Expert in all aspects of Criminal Confiscation, including Restraint Orders, Confiscation Orders and the production of Section 16 Statements. Also experienced in civil recovery cases involving cash seizures etc.

Planning law

Regularly conducts cases involving planning issues and breach of planning legislation. Appeared in the Divisional Court case of Barbara Rees Limited (Estate Agents) v Cardiff County Council 2006 concerning breach of the Town and Country Planning (Control of Advertisement) Regulations 1992, the Town and Country Planning Act 1990 and the Clean Neighbourhoods and Environment Act 2005
