Private prosecution success for Barry Smith

In R v C the first defendant has been sentenced for criminal trade mark infringement following a successful private prosecution at Southwark Crown Court brought by an overseas corporation. The defendant was disqualified from being a company director for 5 years and prosecution costs from central funds were awarded. Confiscation proceedings will follow.
