
Amanda Bostock, led by John Hardy QC, represented the judicial authorities of Germany and Lithuania before the Divisional Court in the case of Puceviciene & Others v Lithuania & Others [2016] EWHC 1862 (Admin) which provides definitive guidance on the practical operation of section 12A, intended to ensure that extradition only takes place when the requesting country has made a clear decision to charge and try. Section 12A was introduced following the highly publicised case of Andrew Symeou who spent 10 months in pre-trial detention in Greece following his extradition for charges upon which he was later acquitted.
