Kane Sharpe’s client acquitted by jury after trial for sexual assault of a train passenger.
The prosecution’s case was that the defendant sexually assaulted a passenger after sitting down next to her. The passenger then moved to a different seat that the opposite end of the train to the defendant, who was subsequently captured on CCTV also proceeding up the train before sitting back down next to the same woman. This prompted her to call the police. At trial, the defence argued that there was no sexual contact and the defendant’s action in relocated within the train was mere coincidence.
The jury acquitted in 35 minutes.
