Katie‘s client was acquitted by a jury at Luton Crown Court less than thirty minutes after they went into retirement. This case involved an allegation of serious violence by her client against his wife founded largely on the eye witness evidence of an off duty police inspector. Katie’s client and his wife had, from the outset, protested his innocence. Despite this and other significant evidential flaws, the alleged victim was ignored and dismissed as unreliable and incredible by police and prosecution alike. After a three year wait for trial, which saw the unsupportive ‘victim’ give birth alone as stringent bail conditions prevented contact with her husband, a jury were able to hear their account and duly, and swiftly, found the defendant not guilty. Katie’s client retains his good character and he and his wife can move on from what they both described as a traumatising ordeal in which she, despite never alleging any assault had taken place, had to give evidence in her husband’s defence and be subject to cross examination by the prosecution. It was a case in which it was at times difficult to see who the public interest was said to be serving.
